This supplement applies to business customers in Australia. It forms part of the agreement with Lyndon Mukandavire trading as Cailub, alongside the Terms and Conditions, Privacy Policy and Data Processing Agreement. Where this supplement and those documents differ, this supplement applies for customers in Australia.

1. Who this supplement applies to

Business customers established in Australia.

2. Who you are contracting with

Cailub is a trading name of Lyndon Mukandavire, a sole trader based in the United Kingdom at 60 Stockport Road, Manchester, M12 6AL, United Kingdom.

Wherever you are based, your contract is with this UK business. The UK GDPR applies to all of Cailub’s processing, the Information Commissioner’s Office (ICO) is our lead regulator, and prices are charged in pounds sterling (GBP). This supplement only adds the local rules that also apply in Australia.

3. Rights that cannot be excluded

Nothing in our terms excludes, restricts or modifies any consumer guarantee or right under the Australian Consumer Law that cannot lawfully be excluded, including where it applies to a small business purchase.

Where the unfair contract terms rules apply to a standard-form contract with a small business, any term found unfair does not apply.

4. Governing law and courts

These terms are governed by the law of England and Wales, subject to the Australian Consumer Law where it applies. The courts of England and Wales have jurisdiction over any dispute, unless mandatory law in your market gives you the right to bring proceedings locally.

5. Your privacy rights and the regulator

Where the Privacy Act 1988 applies, you have the rights in the Australian Privacy Principles, including access and correction.

You can complain to us first, and then to the Office of the Australian Information Commissioner (oaic.gov.au).

Regulator: Office of the Australian Information Commissioner (OAIC).

6. International data transfers

Personal information may be disclosed to the overseas providers listed in the Subprocessor Register. We take reasonable steps, by contract, so they handle it consistently with the Australian Privacy Principles (APP 8).

7. AI disclosure

Every Cailub chatbot shows a notice that the user is talking to an AI. Customers cannot remove it.

Scoring, ranking or eligibility decisions about individuals are disabled.

8. Marketing

Business email only under the Spam Act 2003 inferred consent rule: an address the business publishes itself, with no statement that it does not want unsolicited messages, relevant to the recipient’s role, with accurate sender details and a working unsubscribe. Each email is approved by a person.

9. Tax
