This supplement applies to business customers in Canada. It forms part of the agreement with Lyndon Mukandavire trading as Cailub, alongside the Terms and Conditions, Privacy Policy and Data Processing Agreement. Where this supplement and those documents differ, this supplement applies for customers in Canada.
1. Who this supplement applies to
Business customers established in Canada, outside Quebec.
2. Who you are contracting with
Cailub is a trading name of Lyndon Mukandavire, a sole trader based in the United Kingdom at 60 Stockport Road, Manchester, M12 6AL, United Kingdom.
Wherever you are based, your contract is with this UK business. The UK GDPR applies to all of Cailub’s processing, the Information Commissioner’s Office (ICO) is our lead regulator, and prices are charged in pounds sterling (GBP). This supplement only adds the local rules that also apply in Canada.
3. Rights that cannot be excluded
Nothing in our terms excludes rights that cannot be excluded under the law of your province.
4. Governing law and courts
These terms are governed by the law of England and Wales, subject to any mandatory rules of your province. The courts of England and Wales have jurisdiction over any dispute, unless mandatory law in your market gives you the right to bring proceedings locally.
5. Your privacy rights and the regulator
You have rights under PIPEDA, and in Alberta and British Columbia under their own private-sector privacy laws, including access and correction. You can use them by emailing us.
You can complain to the Office of the Privacy Commissioner of Canada, or to your provincial commissioner where provincial law applies.
Regulator: Office of the Privacy Commissioner of Canada.
6. International data transfers
Personal information may be processed outside Canada by the providers listed in the Subprocessor Register. We use contracts to give it a comparable level of protection.
7. AI disclosure
Every Cailub chatbot shows a notice that the user is talking to an AI. Customers cannot remove it.
8. Marketing
Business email only under CASL implied consent: an address the business publishes itself, with no statement that it does not want commercial messages, about its business role, with full sender details and an unsubscribe honoured within 10 business days. Each email is approved by a person.
